Terms and Conditions
Vetreats accepts bookings subject to the following conditions as laid out below:
INTERPRETATION & DEFINITION
In the agreement unless otherwise specified the following expressions refer to the following meanings.
Booking - The booking made by the client with Vetreats as set out on the booking form.
Booking Form - The booking form produced by Vetreats to be completed by the client when and upon making a booking with Vetreats.
Contract - The contract between the client under which the services are provided by Vetreats to the client.
Client - The person, business or company who makes the booking with Vetreats. All individuals to whom the services are provided by Vetreats must be of a minimum age of 18 years.
Fee - The amount payable to Vetreats under the contract.
Deposit - A non-refundable payment each person will be required to pay to reserve each place at the retreat as specified on booking
Force Majeure - Any act, event, omission or accident beyond Vetreats reasonable control including but in no way limited to Act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, adverse weather, default of suppliers or subcontractors, strikes, or other industrial disputes, failure of a utility service or transport network.
Major Change - A change in the date, location or over 80% of the content of the service.
Recordings - Photographs, videos, or any other audio-visual recordings taken of the clients during the provision of the services.
Wording importing the singular meaning shall include the plural meaning and vice versa.
Web site - the web site that you are currently using and any sub domains of this site unless expressly excluded by their own terms and conditions.
User/Users - any third party that accesses the web site and is not employed by Vetreats and acting in the course of their employment.
System - any on line communications structure that Vetreats makes available via the web site either now or in the future. This includes but is not limited to, web-based e-mail, message boards, live chat facilities and e-mail links.
Service - collectively any on line facilities, tools, services or information that Vetreats makes available via the web site either now or in the future.
Vetreats Vetreats Ltd
Data - collectively all information that you submit to the web site, this includes but is not limited to; account details and information submitted using any of our services or systems.
Cookie - a small text file placed on your computer by Vetreats when you visit certain parts of its web site, this allows us to identify returning visitors and to analyse their browsing habits within the web site. Where e-commerce facilities are provided cookies may be used to store your shopping basket.
Content - any text, graphics images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of this web site.
Account - means collectively the personal information, payment information and credentials used by users to access material and/or any communications systems on the web site.
All wording within the booking conditions is generalized and any reference to any gender includes the other genders.
The headings in these conditions are for convenience only and shall not affect their interpretation.
A contract for the services is made between Vetreats and the client on the issue of a written confirmation of booking by Vetreats. The contract is subject to these booking conditions which the client has been deemed to have read and fully understood. All participants must make themselves aware of the terms and conditions and accept the risks associated with the course activities. These booking conditions can only be varied by written agreement between Vetreats and the client.
To place a booking with Vetreats, Vetreats require a completed booking form together with the payment of a deposit fee. If a booking is made by e-mail, the client shall be deemed to have read and fully understood these conditions. All bookings are provisional and are only confirmed when the deposit payment has cleared Vetreats' bank account. By paying this deposit the client is deemed to have read, understood and agreed to these these terms and conditions.
Vetreats reserves the right to decline any booking at their discretion.
FEE & PAYMENT TERMS
The fee payable at the time of booking shall include the planning, organizing and delivery of the proposed services.
Upon the successful payment of the retreat fee by the client a contract is formed for the agreed program to be delivered, If the client wishes to alter any aspect of the program additional reasonable costs may be levied by Vetreats at their discretion.
The full retreat fee is payable 60 days before the commencement of the course unless agreed otherwise on confirmation of booking. In the event the balance is not paid Vetreats will have the discretion to treat the booking as cancelled by the client and to re-sell the course place, the fees paid by the client will be retained by Vetreats.
Vetreats will charge a late payment fee to those guests who do not pay within the time frame specified in the payment terms and conditions, the late payment fee will be £100.00 per person.
RESPONSIBILITIES OF THE CLIENT
The fee does not include travel to and from the site/location at which the proposed services shall be provided & this shall be the sole responsibility of the client unless otherwise agreed in writing with Vetreats.
The client is responsible for their own personal medical requirements, clothing and footwear for the duration of the services unless otherwise agreed in writing with Vetreats.
It is the client’s responsibility to inform Vetreats in writing of any health issues that may make them unsuitable to participate in the services agreed, failure to disclose any such information may result in Vetreats terminating the contract and withdrawing the client from the services without refund, notwithstanding condition of cancelation by Vetreats.
If you are currently pregnant, or under medical or psychiatric supervision, you must provide a Doctor’s certificate confirming your fitness to travel and take part in the retreat.
All health issues including allergies MUST be disclosed at the time of booking.
Our retreat is not suitable for people under 18 years or for people with physical disabilities that cannot take care or responsibility for themselves as we do not have the resources or expertise. There are areas of the retreat that people with mobility issues may not be able to access.
It is the sole responsibility of the client to ensure that the balance for the cost of their retreat place is paid in full and on time as per the terms set out by Vetreats.
It is the clients’ responsibility to ensure that they have purchased appropriate travel and medical insurance for the full duration of their retreat, as well as the appropriate personal accident, holiday and cancellation insurance for the full duration of the retreat, this is a condition of booking one of our retreats.
The full retreat fee is payable 60 days before the commencement of the course unless agreed otherwise on confirmation of booking. It is the sole responsibility of the client to ensure that their payment is made on time and by the due date, as per the terms and conditions, Vetreats do not chase guest payments or send reminders.
VARIATIONS & AMENDMENTS
Vetreats reserves the right to change any price or other particulars of the services before the contract becomes binding.
If there is a major change Vetreats shall notify the client forthwith, Vetreats shall seek to offer the client arrangements as close to the original as it is reasonably possible in the circumstances. If there is any other change other than a major change Vetreats is not obliged to inform the client in advance or obliged to pay any compensation.
CANCELLATION BY THE CLIENT
If the client wishes to cancel the contract, they must advise Vetreats in writing as soon as reasonably possible. Any cancellation of the contract will be subject to the following cancellation charges. For the avoidance of doubt the cancellation charges are based on the number of days before the arrival date of the services.
Date of cancellation - Cancellation charge
Once you have confirmation of your booking you have a further 24hrs to cancel and obtain a full refund. After this period the following conditions will apply:
If the client has paid in full:
- A full refund minus the deposit and 5% admin charge will be provided for all cancellations up to 120 days prior to start day of the booked retreat.
A 50% refund minus the deposit and 5% admin charge will be provided on cancellations between 119-60 days prior to the start date of the booked retreat.
No refund will be provided on cancellations between 59-0 days prior to the start date of the booked retreat.
No refund will be provided for premature leaving of the retreat or failure to arrive at the retreat for any reason.
If a room is booked for two guests who are sharing and one guest is unable to attend, Vetreats will endeavour to find another guest to share with. Should the attending guest not wish to share a room and opt for solo occupancy, they must pay the difference in price 60 days before the retreat, or immediately if it is taking place within 60 days.
CANCELLATION BY VETREATS
Vetreats will always endeavour to fulfil confirmed bookings. However, Vetreats do reserve the right to cancel. If Vetreats cancels a booking prior to the commencement of the services the client will be offered an alternative date, or a refund.
Vetreats will refund the retreat cost if applicable, but will not pay for any loss with flights.
CANCELLATION DUE TO FORCE MAJEURE
Vetreats will be unable to offer refunds.
The contract may be assigned by the client to a third-party subject in certain conditions.
The client is unable to assign or transfer the contract to a third party without the prior written consent of Vetreats, if the client wishes to assign their contract, he or she must give notice in writing providing the full name, address and contact details of the third party. Vetreats shall then advise in writing as to if it consents to the assignment as soon as is reasonably possible. Vetreats reserve the right to refuse an assignment to a third party at any time and without reason. If subsequently a client must cancel due to Vetreats refusing the assignment to a third-party then the cancellation charges under cancellation by the client shall apply.
Vetreats may assign or sub contract to any third party the performance of any of its obligations under the contract without consent of the client.
Vetreats reserves the right to alter the content of the services at any time without notice to the client due to certain factors, including, but not limited to the weather, staff and any physical fitness of the clients.
Any information on/about our services published by Vetreats for its literature and web site is designed for illustrative purposes only.
If the client elects not to participate in any of the services being provided, Vetreats has no obligation to provide an alternative activity or service and the client will not be entitled to a refund.
If Vetreats believes that a client’s health and safety is at risk, or a client has failed to disclose any relevant health information in accordance with our terms and conditions, Vetreats may at its absolute discretion make decisions affecting the clients and where necessary may terminate the contract immediately.
The client must refrain from any illegal act or any conduct which may give offence or cause danger or damage to any person or property. If Vetreats or any of its staff, consultants or agents become aware of any such action then Vetreats or any of its suppliers may at their absolute discretion have the client immediately removed from any property or facility without refund. Vetreats will have no liability to the client under such circumstances.
EXTRA COSTS incurred by guests while at the retreat
All holistic therapies; private 1-2-1 personal training appointments with any of the retreat team, health and wellbeing members; additional meals; snacks etc will be charged as extras to the cost of the retreat.
Failure of a guest to settle their account (extras) in full prior to departure and as set out by the retreat director will result in the guest’s credit card being charged for the appropriate amount, in addition an administration fee equal to 21% of the total unpaid bill will be added to the charge.
DEFINITION OF FULL BOARD
The definition of full board will either be 3 x meals per day which will be provided as breakfast, lunch and dinner on full retreat days only, OR 2 x meals a day (brunch and dinner) plus snacks throughout the day. On arrival day only welcome dinner will be provided and on departure day only breakfast will be provided as part of the retreat cost. This applies ONLY to the retreat’s official arrival and departure days as specified in the published retreat dates for the appropriate year.
If there is a problem during the services, the client must report it in the first instance to the course manager/retreat director, if it is still unresolved then the issue should be reported immediately to the Director of Vetreats so that all efforts may be made to resolve the problem promptly and effectively. In the unlikely event that the problem cannot be resolved, and the client wishes to make a complaint then the client must notify Vetreats in writing within seven days of the end of the services. Failure to provide notice of the complaint in accordance with the above will preclude the client from being entitled to take any further action against Vetreats.
Vetreats take no responsibility for the actions of the person/s with whom you ‘room share’. If for whatever reason you are unhappy with your ‘room share’ including but not limited to: clash of personalities; disagreements; snoring; other annoying habits etc, Vetreats cannot be held responsible.
The retreat will be deemed to finish at 10:00 am exactly on the retreats official day of departure as specified by Vetreats.
The venue has a check out policy which requires guests to vacate their suites on the agreed day of departure by no later than 10:00 am.
None of the exclusions and limitations in these conditions are intended to limit any rights the client may have under statute or common law which may not be excluded, nor in any way to exclude or limit liability to the client for personal injury or death resulting from Vetreats negligence or that of its employees or agents, or for any liability incurred as a result of fraud or fraudulent misrepresentation by Vetreats.
The client understands that attending any activity or service provided by Vetreats involves some level of risk. These risks include but are not limited to physical injury or even death. By attending any activity or service provided by Vetreats, the client agrees to assume these risks and agrees to release and discharge Vetreats and its Directors, employees, agents from any and all claims for liability.
Neither Vetreats nor any of its Directors, employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to the client during the services.
It is the sole responsibility of the client to purchase full and adequate medical, personal injury and holiday insurance for the full duration of their stay with Vetreats.
It is the sole responsibility of the client to arrange and pay for any necessary visas.
All guests must refrain from any illegal act or any conduct unbecoming a retreat guest, conduct or language which may give offence to a team member or guest or any act which may cause damage to property. If Vetreats or any of its staff, consultants or agents become aware of any such conduct then Vetreats and its agents may, at their absolute discretion, ask the client to leave the premises, property or facility, this will be without refund to the guest, in these circumstances Vetreats will have no further responsibility or liability to the guest.
Vetreats reserve the right to take any recordings of the client during the services, and the client accepts that all rights whatsoever arising in the recordings shall be solely owned by Vetreats. The client accepts and agrees that any recordings may be used by Vetreats at its absolute discretion in any manner, including but not limited to its website, social media, promotional material and advertisements.
Vetreats reserves all copyright which may subsist in the products of, or in connection with, the provision of all activities, services or facilities. Vetreats reserves the right to take such actions as it deems appropriate or necessary to restrain or prevent infringement of such copyright.
LAW & JURISDICTION
These terms and conditions shall be governed and construed in accordance with UK law, and the parties shall submit to the non-exclusive jurisdiction of the UK courts.
THIRD PARTY WEB SITES and SERVICES
Vetreats may, from time to time, employ the services of other parties for dealing with matters that may include, but are not limited to, payment handling, delivery of purchased items, search engine facilities, advertising and marketing. The providers of such services do have access to certain personal data provided by users of this web site.
YOUR RIGHT TO WITHHOLD INFORMATION
You may access certain areas of the web site without providing any data at all. However, to use all services and systems available on the web site you may be required to submit account information or other data.
CHANGES TO THIS POLICY
Without limitation, any of the following data may be collected;
Name, date of birth, gender, job title, profession, contact information such as e-mail addresses and telephone numbers, demographic information such as post code, preferences and interests. IP address (automatically collected) web browser type & version (automatically collected) operating system (automatically collected) a list of URLs starting with a referring site, your activity on this site, and the site you exit to (automatically collected) and cookie information (see above).
